Terms & Conditions

Please read these terms carefully before booking any service with Powell Pools. By proceeding with a booking you confirm your acceptance of these terms.

These terms and conditions govern all services provided by Powell Pools, operated by Robert Powell as a sole trader, based in High Wycombe, Buckinghamshire. By booking or agreeing to any service, you accept these terms.


1. The Service Provider

Powell Pools is operated by Robert Powell (sole trader).

2. Bookings & Agreements

2.1 All work is agreed in advance. A booking is confirmed once Rob has accepted your request by phone, WhatsApp, or email.

2.2 A clear scope of work and price will be confirmed before any work begins. No work will be carried out without prior agreement.

2.3 For ongoing maintenance contracts, the agreed schedule and pricing applies until either party provides notice to change or cancel.

2.4 For supply and installation jobs, Powell Pools strongly recommends all agreements are confirmed in writing prior to any goods being ordered.


3. Pricing & Payment

3.1 All prices are quoted and charged exclusive of VAT. Powell Pools is not VAT registered.

3.2 Pool maintenance is charged at £70 per hour, with the duration confirmed on your service report after each visit.

3.3 Hot tub servicing is charged at fixed service rates as quoted. Repair and call-out work is charged at £70 per hour plus the cost of any parts required.

3.4 Chemicals supplied during a visit are charged separately at competitive trade prices and will always be discussed with you before use.

3.5 Travel charges apply to hot tub service calls outside the local zone (0–15 miles from High Wycombe). Current travel charges are:
— Extended zone (15–30 miles): £15
— Specialist zone (30–40 miles): £25
Travel charges are waived for properties with both a pool and hot tub when both are serviced in the same visit. Powell Pools operates within a maximum 40-mile radius of High Wycombe.

3.6 Payment is due upon completion of each visit unless a separate payment schedule has been agreed in writing. Accepted methods include bank transfer, cash, and card.

3.7 Invoices not settled within 14 days of the due date may be subject to a late payment charge.

3.8 Goods remain the property of Powell Pools until full payment has been received.


4. Deposits

4.1 For supply and installation jobs, Powell Pools requires payment in full prior to goods being ordered and work being scheduled. By making payment in full, the customer confirms acceptance of these terms including the cancellation and supply provisions set out in Sections 5 and 6.

4.2 Where a deposit is required, this will be confirmed in writing at the time of quotation. The deposit amount will be clearly stated and deducted from the final invoice.

4.3 Deposits are non-refundable once goods have been ordered or work has been scheduled, except where Powell Pools is unable to fulfil the agreed work through our own fault.


5. Supply & Installation of Goods

5.1 Where Powell Pools supplies and installs equipment or materials on your behalf, goods are ordered specifically for your project once payment or deposit is received.

5.2 Once goods have been ordered, the installation and labour element of the agreed quote is considered earned and is non-refundable. This covers planning, coordination, scheduling, supplier liaison and any preparatory work carried out on your behalf.

5.3 In the event of cancellation after goods have been ordered, the customer is responsible for any supplier restocking fees incurred. Where possible, goods will be returned to the supplier and the remaining balance — less the installation/labour element and any restocking fees — refunded to the customer.

5.4 Powell Pools will make every reasonable effort to source and supply goods as agreed. In the event that specific goods become unavailable, an equivalent alternative will be offered and agreed with the customer before proceeding.

5.5 Goods remain the property of Powell Pools until full payment has been received in cleared funds.


6. Cancellations & Rescheduling

6.1 If you need to cancel or reschedule a visit, please give at least 48 hours notice where possible.

6.2 Cancellations made with less than 24 hours notice may be subject to a charge of up to 50% of the scheduled visit cost to cover lost time and travel.

6.3 Powell Pools reserves the right to reschedule visits due to adverse weather, illness, or circumstances outside our control. You will be notified as soon as possible and an alternative date offered promptly.


7. Force Majeure

7.1 Powell Pools shall not be liable for any failure or delay in performing services where such failure or delay results from circumstances beyond our reasonable control, including but not limited to illness, extreme weather, supplier delays, bereavement, or other unforeseen events.

7.2 In such circumstances, Powell Pools will notify you as soon as reasonably possible and make every effort to reschedule at the earliest opportunity.

7.3 Similarly, where a customer is unable to proceed with an agreed installation due to circumstances beyond their reasonable control, Powell Pools will handle the situation with sensitivity and reasonable flexibility, subject to the terms set out in Section 5.


8. Scope of Work & Additional Work

8.1 All work is carried out to the scope agreed at the time of booking. If additional work is identified during a visit, this will be discussed and agreed with you before proceeding.

8.2 No additional work will be carried out without your approval. If approval cannot be obtained during the visit, the additional work will be noted on the service report and scheduled separately.

8.3 Powell Pools accepts no liability for pre-existing faults, damage, or deterioration identified during a visit that falls outside the agreed scope of work.


9. Chemicals & Water Treatment

9.1 All chemical handling is carried out in accordance with current health and safety regulations and COSHH guidelines.

9.2 Chemicals are supplied at competitive trade prices and charged separately. You will always be informed of what chemicals are being used and why.

9.3 Powell Pools cannot guarantee water quality outcomes where conditions at the property — such as contamination, heavy bather load, or equipment failure — are outside our control.


10. Access & Site Conditions

10.1 You agree to ensure safe and clear access to the pool, hot tub, plant room, and any associated equipment at the agreed time of visit.

10.2 If access cannot be gained at the agreed time through no fault of Powell Pools, a call-out charge may apply.

10.3 You are responsible for informing Powell Pools of any known hazards at the property prior to the visit.


11. Photography & Marketing

11.1 Powell Pools may photograph completed work for use on our website, social media, and marketing materials.

11.2 No personally identifiable information — including property addresses or customer names — will be shared without your express permission.

11.3 If you would prefer that no photographs are taken at your property, please inform Rob prior to the visit and your wishes will be respected without question.


12. Liability & Insurance

12.1 Powell Pools is fully insured for public liability for both residential and commercial work.

12.2 Powell Pools will not be liable for any loss or damage that arises from pre-existing faults, failure of equipment not serviced by Powell Pools, or circumstances outside our reasonable control.

12.3 Our liability in any circumstances is limited to the value of the work carried out on the specific visit or job in question.


13. Data Protection

13.1 Powell Pools collects and processes personal data only as necessary to provide our services. This includes your name, contact details, and property information.

13.2 Your data will never be sold or shared with third parties for marketing purposes.

14. Complaints

14.1 If you are unhappy with any aspect of the service, please contact Rob directly as soon as possible — by phone, WhatsApp, or email.

14.2 All complaints will be acknowledged within 2 business days and investigated fairly and promptly.

14.3 Powell Pools aims to resolve all complaints to your satisfaction. Where a genuine error has occurred, remedial work will be carried out at no additional charge.


15. Governing Law

These terms are governed by the laws of England and Wales. Any disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of England and Wales.
